Terms of Service

These Terms of Service ("Terms") govern your use of the Kipi mobile application ("App") operated by Kipi ("we", "us", or "our").

By using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years old and agree to these Terms and our Privacy Policy.

2. Account Responsibilities

  • You must provide accurate information when creating an account via Google or Apple sign-in.
  • You are responsible for maintaining the security of your account.
  • You must not share your account with others or allow unauthorized access.
  • You are responsible for all activity that occurs under your account.

3. User-Generated Content

Your Content

You retain ownership of the content you create in the App, including diary entries, photos, videos, and comments. By posting content, you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the App's services.

Zero Tolerance for Objectionable Content

Kipi has a zero tolerance policy for objectionable content and abusive behavior. You agree not to post content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Contains hate speech or promotes discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic
  • Is sexually explicit, pornographic, or exploitative
  • Depicts, promotes, or facilitates child sexual abuse or exploitation (CSAE) — see our Child Safety Policy for details
  • Contains graphic violence or gore
  • Promotes self-harm, suicide, or eating disorders
  • Infringes on others' intellectual property or privacy rights
  • Contains spam, malware, or deceptive content
  • Impersonates another person or entity
  • Bullies, intimidates, or personally attacks other users

Content Enforcement

We take violations seriously:

  • Reporting: All users can report objectionable content and abusive users directly within the App.
  • Review: We review all reports and act on objectionable content within 24 hours of receiving a report.
  • Removal: Content that violates these rules will be removed immediately upon confirmation.
  • Account Action: Users who post objectionable content will have their accounts suspended or permanently banned. Repeat offenders will be permanently removed from the platform.
  • Content Filtering: We employ automated content filtering to proactively detect and prevent objectionable content from being posted.

4. Rooms and Pen Names

  • Rooms are shared diary spaces where members post entries and interact.
  • Pen Name rooms allow members to use pseudonyms. Even in Pen Name rooms, all content rules apply and we retain the ability to identify and take action against users who violate these Terms.
  • Room creators are responsible for moderating content within their rooms.
  • Room members must follow the content rules above and any additional rules set by room creators.
  • We may remove rooms or restrict access to rooms that violate these Terms.

5. User Conduct

You agree to:

  • Treat other users with respect and courtesy
  • Not use the App to harass, bully, stalk, or threaten others
  • Not attempt to circumvent any content moderation or safety measures
  • Not use the App for any unlawful purpose
  • Report any content or behavior that violates these Terms

6. Blocking and Safety

  • You may block other users to prevent them from interacting with you.
  • Blocked users will not be able to see your content or contact you within the App.
  • You can report abusive users at any time through the App's reporting feature.

7. In-App Purchases and Virtual Currency

Purchases

The App offers purchasable items including stickers, themes, and coins, processed through RevenueCat and the respective app store (Apple App Store or Google Play Store).

Refunds

All purchases are subject to the refund policies of the respective app store. We do not directly process refunds.

Virtual Currency

  • Coins have no real-world monetary value and cannot be exchanged for cash.
  • We reserve the right to modify the pricing, availability, or functionality of purchasable items.
  • Unused coins and purchased items are non-transferable between accounts.

8. Advertising

The App displays advertisements through Google AdMob, including rewarded video ads. By using the App, you acknowledge that ads may be displayed during your use. On iOS, we will request your consent via App Tracking Transparency before using your data for personalized advertising.

9. Intellectual Property

  • The App, including its design, code, graphics, and branding, is owned by us and protected by intellectual property laws.
  • You may not copy, modify, distribute, or reverse-engineer any part of the App.
  • "Kipi" and associated logos are our trademarks.

10. Termination

By You

You may delete your account at any time through the App's settings. Account deletion is subject to a 30-day grace period during which you may cancel the request. After 30 days, your data is permanently deleted in accordance with our Privacy Policy.

By Us

We may suspend or terminate your account at any time if you violate these Terms, with or without notice. Upon termination, your right to use the App ceases immediately. Users who post objectionable content or engage in abusive behavior will be ejected from the platform.

11. Disclaimers

  • The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee that the App will be uninterrupted, error-free, or secure.
  • We are not responsible for any content posted by users.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or by other means. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
